Last updated: June 2025 · Please read carefully before engaging SuperSITE for any project. These terms protect both parties.
By submitting an enquiry, signing a Project Proposal, or making any payment to SuperSITE (Super Site Web Design & Development, Lahore, Pakistan — hereinafter "SuperSITE", "we", "us", or "our"), you ("Client", "you") agree to be bound by these Terms & Conditions ("Terms"). These Terms apply to all web design, web development, e-commerce development, SEO, social media marketing, logo design, branding, website maintenance, and related digital services provided by SuperSITE.
A "Project" means any specific engagement agreed to in writing (email or signed proposal). A "Deliverable" means any work product created by SuperSITE for a Project. "Content" means all materials — text, images, video, data, logos — provided by the Client for use in a Project.
These Terms, together with the written Project Proposal issued by SuperSITE for each project, constitute the entire agreement between the parties and supersede all prior discussions, representations, or understandings, whether oral or written. No verbal promises, informal WhatsApp messages, or informal emails modify these Terms unless confirmed in a written, signed amendment. In the event of conflict between these Terms and a Project Proposal, the Project Proposal prevails on that specific point only.
The specific deliverables, milestones, timelines, and pricing are defined in a written Project Proposal issued by SuperSITE before work begins. Any work requested outside the agreed scope ("scope creep") requires a written change request and will be quoted separately before additional work commences. SuperSITE reserves the right to decline any change request that is outside our area of expertise or conflicts with our professional standards.
Project timelines provided in the Project Proposal are estimates based on agreed scope and normal working conditions. They are not guaranteed completion dates. Actual delivery may be affected by:
SuperSITE will notify the Client promptly of any significant delays and revised timelines. SuperSITE is not liable for any consequential losses arising from project delays, regardless of cause.
The Client agrees to:
Work progresses in stages: design, development, content integration, and testing. At the end of each stage, SuperSITE will request written approval from the Client (email constitutes written approval). Once a stage is approved:
Final delivery approval by the Client triggers the final payment obligation and constitutes acceptance of the completed project.
Each project phase includes revision rounds as specified in the Project Proposal (typically 2 rounds of revisions per design phase). Revisions must be submitted as a single consolidated list at each round — not piecemeal over multiple emails. Revision rounds beyond the included allowance will be charged at SuperSITE's standard rate of Rs. 5,000 per hour (minimum 1 hour, subject to change with 30 days' notice). Corrections of errors that are demonstrably SuperSITE's fault are not counted as revision rounds.
If the Client becomes unresponsive during a project:
The Client retains full ownership of all Content (text, images, video, logos, brand assets) that they provide. By providing Content, the Client warrants that they have the right to use it commercially and grants SuperSITE a royalty-free licence to use it solely for delivering the agreed project.
Upon receipt of final payment in full, SuperSITE assigns to the Client all rights in the original design work and custom code created specifically for the project. Ownership transfers only after full payment is received and cleared. Until that point, SuperSITE retains all rights in all work product.
Projects typically incorporate third-party components: WordPress, Elementor Pro, WooCommerce, Shopify, stock photography, icon libraries, fonts, and plugins. These remain subject to their respective licences and are not transferred to the Client as owned assets. Where commercially licensed plugins, themes, or stock images are used, the Client is responsible for obtaining and maintaining the appropriate licence after project handover. SuperSITE will identify all third-party components in the handover documentation.
Proprietary code, frameworks, template systems, and internal tools developed by SuperSITE that pre-exist or are developed independently of the project remain SuperSITE's intellectual property. These are licensed for use in the Client's specific project only and are not transferred or sub-licensable.
SuperSITE reserves the right to display the completed project (screenshots, live URL, description) in our portfolio and marketing materials, including on our website, social media, and case studies. If the Client does not consent to portfolio usage, they must notify us in writing within 30 days of project completion.
Unless explicitly stated in the Project Proposal, SuperSITE does not provide or resell hosting or domain registration. We strongly recommend that the Client register hosting and domains in their own name to ensure full ownership and control. SuperSITE can assist with setup and DNS configuration but is not responsible for: hosting uptime, server security, domain renewal, email deliverability, or any service outages caused by third-party hosting providers once the project is handed over. Any hosting purchased or provisioned by SuperSITE on behalf of a Client at the Client's request is provided at the Client's risk and expense.
All projects include 30 days of complimentary post-launch support covering: bug fixes caused by SuperSITE's work, minor content corrections, and guidance on using the CMS. This support period does not include new features, design changes, or issues caused by third-party software updates, hosting changes, or Client modifications.
After the 30-day support period, ongoing maintenance (CMS/plugin updates, security patches, uptime monitoring, performance optimisation, content updates, daily backups) requires a separate paid Maintenance Plan. Without a Maintenance Plan, SuperSITE is not responsible for: plugin or theme vulnerabilities, website downtime, data loss, hacks or malware infections, compatibility issues caused by PHP or WordPress core updates, or any degradation of site performance caused by third-party changes.
SuperSITE does not guarantee specific search engine rankings, positions, organic traffic volumes, lead generation volumes, social media follower growth, or advertising conversion rates. Search engine algorithms change frequently and rankings are influenced by numerous factors outside our control, including competitor activity, algorithm updates, and domain history.
We follow Google's Webmaster Guidelines (white-hat SEO only). Any tactics that violate search engine guidelines are outside our scope. SuperSITE provides monthly reporting on work completed. SEO results typically take 3–6 months to become measurable. Early cancellation of an SEO retainer does not entitle the Client to a refund for work already delivered.
For social media marketing, the Client is responsible for reviewing and approving all content before publication unless a standing approval is provided. Content submitted for approval is considered approved if no response is received within 5 business days. SuperSITE is not liable for content that is approved by the Client and subsequently found to violate platform policies or applicable law.
SuperSITE warrants that it will perform services with reasonable care and skill in accordance with good industry practice. Except as expressly stated, all services and deliverables are provided "as is" and "as available" without any further warranty, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. SuperSITE does not warrant that:
To the fullest extent permitted by applicable law:
The Client agrees to indemnify, defend, and hold harmless SuperSITE and its employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to:
SuperSITE will notify the Client promptly of any third-party claim that triggers this indemnification obligation, and the Client will cooperate in the defence of such claims.
Both parties agree to keep confidential all proprietary information received from the other party during the course of the project, including but not limited to: business strategies, pricing, technical architecture, client lists, and source code. SuperSITE will not disclose the Client's confidential information to third parties without prior written consent, except where required by law or court order. This obligation survives termination of the agreement for a period of 2 years.
Where the Client requires a formal Non-Disclosure Agreement (NDA) before sharing sensitive business information, one can be arranged on request prior to project commencement.
SuperSITE shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure is caused by circumstances beyond SuperSITE's reasonable control, including but not limited to: acts of God, natural disasters, floods, earthquakes; epidemics or pandemics; civil unrest, protests, riots, or government-imposed lockdowns; power outages or load-shedding affecting SuperSITE's operations; internet service provider failures or nationwide internet disruptions; actions of government or regulatory authorities; strikes or labour disputes; or failure of third-party suppliers or services.
In the event of a Force Majeure situation, SuperSITE will notify the Client as soon as practicable and will resume performance as soon as the situation is resolved. Neither party shall be entitled to terminate the agreement solely due to a Force Majeure event lasting less than 60 days.
During the term of any project and for a period of 12 months after its completion or termination, the Client agrees not to directly or indirectly solicit, recruit, or employ any employee, contractor, or team member of SuperSITE who was involved in delivering services to the Client, without SuperSITE's prior written consent. A breach of this clause entitles SuperSITE to a one-time fee equivalent to 6 months of the relevant individual's gross earnings, as liquidated damages and not as a penalty.
SuperSITE is an independent contractor. Nothing in these Terms creates an employment relationship, agency, partnership, or joint venture between SuperSITE and the Client. SuperSITE retains the right to perform services for other clients, provided this does not create a conflict of interest with the Client's project. SuperSITE is responsible for its own tax obligations and is not entitled to employee benefits.
These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.
In the event of any dispute arising from or relating to these Terms or any project:
The prevailing party in any legal dispute shall be entitled to recover reasonable legal costs from the losing party, subject to the court's discretion.

This website is provided "as is" and "as available." SuperSITE makes no warranty that the website will be uninterrupted, error-free, or free from technical inaccuracies. We reserve the right to withdraw or modify any content on this website without notice.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.
Failure by either party to enforce any provision of these Terms on any occasion shall not constitute a waiver of that party's right to enforce that provision in the future. No waiver shall be effective unless made in writing and signed by the waiving party.
